The Individuals with Disabilities Education Improvement Act (IDEA 2004) reauthorized by Congress on November 19, 2004 and signed into law on December 3, 2004, includes revisions to IDEA 97 as well as some new provisions. All provisions of the new special education law are effective July 1, 2005. West Virginia must assure that the provision of Part C/WV Birth to Three services is consistent with the new requirements. Current WV Birth to Three policies and procedures, in coordination with IDEA 2004 requirements, will be the authority for the provision of Part C/WV Birth to Three services pending the publication of the Federal regulations and revised State policies and procedures.
Public Notice
The public is hereby notified that the Department of Health, Bureau for Public Health, Office of Maternal, Child and Family Health (OMCFH), and WV Birth to Three is posting the State’s draft application for (FFY) 2024 funds under Part C of the Individuals with Disabilities Education Act (IDEA), for public comment. This grant application is required by the U.S. Department of Education, Office of Special Education Programs as a condition of a state receiving funding under Part C of IDEA.
With the reorganization of the Department of Health and Human Resources, the Governor designated the Department of Health as the new lead agency for WV Birth to Three effective January 1, 2024. WV Birth to Three will be applying for contingent approval of the (FFY) 2024 grant application to allow time to revise policies and procedures to reflect the change in lead agency and to meet our obligations under Part C of IDEA.
The application is available for review through May 22, 2024. Persons wanting to submit written comments on the State’s application for (FFY) 2024 funds under Part C of IDEA, may do so by sending to Regina.K.Woodcock@wv.gov or by mail to: Regina Woodcock, Director, WV Birth to Three, 350 Capitol Street, Room 427, Charleston, WV 25301. Written comments are due prior to May 22, 2024.
