Arrearage: A condition that exists when the child support due is not
paid and the amount equals at least one month's obligation amount.
Caretaker: The parent who has temporary or legal physical
custody of a dependent child. The parent to whom child support is paid.
Child Support Guidelines: A standard method for setting the
amount of child support obligation based on the income of both parents and other
factors as determined by state law. AKA child support guidelines.
Child Support: A court ordered or administratively-ordered
monetary amount to be paid by an obligor.
Custodial Parent: See Caretaker.
Income Tax Offset Project: Process by which an individual's personal income
tax refund, either state or federal, may be intercepted for the non-payment of child
support arrearages.
Income Withholding: The mechanism by which an employer
withholds an amount from an
employee's wages to satisfy the employee's court-ordered child support obligation.
Locate/Central Registry: This unit is responsible for receiving,
distributing and responding to inquiries on all incoming interstate IV-D cases, including
Uniform Interstate Family Support Act (UIFSA) petitions and requests for income withholdings in IV-D cases. Location means information concerning the physical whereabouts
of the obligor, or the obligor's employer(s), other sources of income or
assets, as appropriate, which is sufficient and necessary to take the next appropriate
action in a case.
Long-Arm Statute: A State law which allows a State to exert personal
jurisdiction over a non-resident for purposes of service of process.
Non-Custodial Parent: The parent who was not awarded legal
custody of a dependent child.
Parent who owes a legal duty of support.
Obligee: See Caretaker.
Obligor: See non-custodial parent.
Paternity Establishment: The legal process by which the biological
father of child is legally determined.
Pro-Se Modification: A method by which a parent may attempt to
establish, modify
or change the amount of child support ordered without representation by an attorney
(pro-se) in a court of law.
Temporary Assistance for Needy Families (TANF): Public assistance
benefits paid on behalf of needy, dependent children, provided by Title IV-A of the Social
Security Act. Formerly known as Aid to Families with Dependent Children (AFDC),
Uniform Interstate Family Support Act (UIFSA): A remedy established
under federal law, and adopted by all the States, for enforcement, establish of
paternity, establishment of support and child support laws between states.
